The Citizenship Amendment Bill 2019 (CAB) is a bill amending the Citizenship Act of 1955 that makes Religious Persecuted Minorities of Hindus, Sikhs, Buddhists, Jains, Parsis and Christians from Afghanistan, Bangladesh and Pakistan, who entered India on or before 31 December 2014, eligible for Indian citizenship. It also seeks to relax the requirement of residence in India for citizenship by naturalisation from 11 years to 5 years for these migrants. Immediate beneficiaries of the Bill, according to IB records, will be just over 30,000 people.

The Union Cabinet cleared the Bill on 4 December 2019. It was passed by the Lok Sabha on 10 December 2019 and, subsequently, in the Rajya Sabha on 11 December 2019.

During the 2014 elections, the Bharatiya Janata Party had promised to grant citizenship to Hindu refugees from Bangladesh and Pakistan. In the party’s election manifesto in 2014, the BJP had promised to welcome Hindu refugees and give shelter to them. The Citizenship (Amendment) Bill, 2016 was introduced and passed in Lok Sabha but there was widespread political opposition and protests in the northeast India. Their chief concern was that the demography of Northeast India will change with the influx of migrants from Bangladesh.

In the 2019 election campaign, the BJP’s manifesto reiterated its commitment to bring in the Bill. The National Register of Citizens (NRC) was updated in Assam state in 2019, leaving out 1.9 million residents, a majority of whom were Hindus, without citizenship. This matter brought urgency to the bring in the Bill.

Necessity of The Citizenship Amendment Bill 2019 (CAB)

As early as 1970, India accepted that Liaquat-Nehru Pact over treatment of their minorities failed and in spite of that, India gave a long rope to Pakistan in the hope that it will mend it’s ways. In fact, the problem became even more serious during the Bangladesh Liberation War where Rape was used as an official policy by Pakistan. Though India expected things to stabilize post liberation, the assassination of Sheik Mujibur Rahman and the rise of Zia-ur-Rahman and BNP which tried to whitewash the Pakistani atrocities and bring the situation to pre-1971 levels only complicated the issues. Hindu population was 12.9% of the total Population of Pakistan after the Partition in 1947. It fell down to 7.5% in 1998 and further diminished to 1.6% largely due to Forced Conversions in Pakistan or they were murdered or due to migration of Refugees to India and other countries. Pakistan sponsored Taliban which came to power in Afghanistan and the treatment it meted out to minorities would make anyone shudder. The number of Sikhs in Afghanistan came down from 35000 to 500.

Legislative History

The Bill was introduced in Lok Sabha on July 19, 2016 as the Citizenship Amendment Bill, 2016. It was referred to the Joint Parliamentary Committee on August 12, 2016. The Committee submitted its report on January 7, 2019.

In January 2016, the Citizenship Amendment Bill was introduced to amend the Citizenship Act, 1955.  It was introduced in Lok Sabha on 19 July 2016 and was referred to a Joint Parliamentary Committee on 12 August 2016, which submitted its report on 7 January 2019. It was passed by Lok Sabha on 8 January 2019. It lapsed with the dissolution of the 16th Lok Sabha.

Subsequently, the Union Cabinet cleared the Citizenship (Amendment) Bill, 2019 on 4 December 2019 for introduction in the parliament. The Bill was introduced in 17th Lok Sabha by the Minister of Home Affairs Amit Shah on 9 December 2019 and was passed on 10 December 2019 at 12:11 a.m. with 311 MPs voting in favour and 80 against the Bill.

The bill was subsequently passed by the Rajya Sabha on 11 December 2019 with 125 votes in favour and 99 votes against it. Those voted in favour included BJP allies such as Janata Dal (United), AIADMK, Biju Janata Dal, TDP and YSR-Congress, apart from BJP.

Provisions

The Bill amends the Citizenship Act of 1955 to make illegal migrants who are Hindus, Sikhs, Buddhists, Jains, Parsis and Christians from Afghanistan, Bangladesh and Pakistan, who entered India on or before 31 December 2014, eligible for Indian citizenship. Under the Act, one of the requirements for citizenship by naturalization is that the applicant must have resided in India during the last 12 months, and for 11 of the previous 14 years. The Bill relaxes this 11-year requirement to five years for persons belonging to the same six religions and three countries. The bill exempts the tribal areas of Assam, Meghalaya, Mizoram, and Tripura, included in the Sixth Schedule to the Constitution from its applicability. These tribal areas include Karbi Anglong in Assam, Garo Hills in Meghalaya, Chakma district in Mizoram, and Tribal Areas district in Tripura. It also exempted the areas regulated through the Inner Line Permit which includes Arunachal Pradesh, Mizoram and Nagaland. The inclusion of Manipur in Inner Line Permit is also announced on 10 December 2019.

The Bill includes new provisions for cancellation the registration of Overseas Citizenship of India (OCI) such as registration through fraud, in case of OCI holder sentenced to imprisonment for two or more years within five years of registration and in necessity in the interest of sovereignty and security of India. It also includes a provision on violation of any law notified by the central government. It also adds the opportunity for the OCI holder to be heard before the cancellation.

Congress spreading confusion over Citizenship Amendment Bill : Shivraj Singh Chouhan

Senior BJP leader Shivraj Singh Chouhan has alleged that the opposition Congress was creating confusion over the CAB. “It (CAB) is not against any community and religion. India is a country of Muslims and it will remain so for them. The opposition is creating confusion across the country on the CAB,” Chauhan told reporters in Dhanbad.

Shiv Sena MPs are not present in the Rajya Sabha as voting for the amendments to CAB are on.

08:51 PM Wednesday 11-December 2019, Citizenship Amendment Bill was passed in the Rajya Sabha by 125 votes to 105. It had been passed in the Lok Sabha on Monday

Why the opposition and Muslims in India are angry against CAB. 

The Citizenship Amendment Bill 2019 (CAB) considers three categories

1. People who formally applied asylum 

2. People who illegally infiltrated India

Opposition is because the bill refuses to give citizenship to those Bangladeshis Muslims who illegally entered India and also refuses to give citizenship to Rohingya Bengali Muslims who committed genocide of thousands of Hindus and Buddhists in Myanmar and infiltrated into India via Bangladesh border. Further this opposition is fueled by the Political Parties who used Bangladeshi Muslims and Rohingya Bengali Muslims as their vote bank.

This confirms two things.

1. The protests in North East are primarily to scare the Japanese away. Japanese Prime Minister Shinzo Abe was slated to attend an annual summit with Prime Minister Narendra Modi in Assam’s Guwahati on December 15-16. If the meeting in Guwahati is to be cancelled, it is likely to be held in Delhi’s Hyderabad House. As per the schedule, the two leaders will reportedly visit Manipur after attending the two-day summit in Guwahati. Any cancellation of meetings mean it’s disadvantage Assam and some other state will get the benefits. Who will benefit by this loss to Assam? As per people, “Definitely it’s Liberal opposition political parties with support from Pakistani agencies with nexus with opportunist Muslim leaders who represents Bangladeshi Muslims.” For them whole state will lose this opportunity for Economic Development.

2. The exclusion of Muslims means all those Bangladeshi infiltrators can’t become Indian citizens using The Citizenship Amendment Bill 2019 (CAB). Hence the anger.
