China is using its state funded infrastructure companies in various parts of Asia and Africa and have recently come under the scanner of the World Bank for alleged gross financial malpractices. After detailed investigations, World Bank lists 198 Chinese Ineligible firms and individuals. World Bank temporarily banned some of the Chinese companies while extending the ban for many Chinese companies till the year 2999 that are involved in the projects for their gross financial malpractices, money laundering and corrupt practices.

The World Bank recently debarred China Railway Construction Corporation and its wholly owned subsidiaries, China Railway 23rd Bureau Group Co and China Railway Construction (International), for nine months recently, citing misconduct during the procurement process for the ‘East-West Highway Corridor Improvement Project’ in Georgia. This project is part of China’s mega Belt & Road Initiative (BRI). They and their subsidiaries are operating in several countries including Pakistan, Nepal, Bangladesh and other Asian and African countries.

These companies have acknowledged that they had misrepresented facts about their personnel, equipment and work experience in the pre-qualification and bidding documents of the highway construction contract. World Bank Procurement Guidelines term such misrepresentation of facts as fraudulent practice. Initially, after nine months’ debarment, the companies would be on the WB watch list for 24 months and would be eligible to participate in World Bank-funded projects as long as they complied with their obligations under the settlement agreement. In 2009, China Communications Construction Co, one of the most active companies in BRI projects, was debarred by the WB for eight years for alleged fraudulent bidding on a highway contract in the Philippines.

In 2018, China Harbour Engineering was publicly accused of offering a bribe to a government official in connection with a highway construction project in Bangladesh. The Wall Street Journal reported that Chinese officials had agreed to help bail out Malaysia’s state development fund 1 Malaysia Berhad (1MDB) by inflating cost of infrastructure projects in the Southeast Asian country.

The Chinese embassies in many countries have been trying to limit the damage, and have been issuing guidelines to Chinese companies operating in those countries. In one such case in the UAE, the Chinese Embassy has asked Chinese enterprises to be aware of local social conditions, customs and abide by relevant laws and regulations, especially in project bidding, contracting and labor rights. These Chinese companies were asked by the embassy to consciously resist commercial bribery and put an end to illegal employment and attach importance to safety in production and construction work. The enterprises were asked to pay attention to local public opinion, especially media reportage and public concerns related to Chinese projects. Even in Pakistan, public opposition to the China–Pakistan Economic Corridor project and anger against overwhelming Chinese presence have grown sharply since Imran Khan’s government took over. BRI-related projects are facing backlash also in parts of Africa and Europe.

Cross-Debarment

In February 2006, the Joint International Financial Institution Anti-Corruption Task Force agreed to work towards a “consistent and harmonized approach to combat corruption in the activities and operations of the member institutions,” recognizing that “a unified and coordinated approach is critical to the success of the shared effort to fight corruption and prevent it from undermining the effectiveness of their work”

It was agreed that the institutions would, among other initiatives, “explore further how compliance and enforcement actions taken by one institution can be supported by the others.” This agreement was predicated on the understanding that “mutual recognition of … enforcement actions would substantially assist in deterring and preventing corrupt practices.”

Those Multilateral Development Bank (MDB) taking part in the Task Force are the African Development Bank (AfDB), the Asian Development Bank (AsDB), the European Bank for Reconstruction and Development (EBRD), the European Investment Bank (EIB), the International Monetary Fund (IMF), the Inter-American Development Bank (IADB), and the World Bank Group (WBG).

During the course of 2009 and 2010, representatives of five of the six MDBs that met in early 2009 – the AfDB, AsDB, EBRD, IADB and the WBG – met to discuss and agree on the critical elements of a cross-debarment regime.

Cross-debarment would also significantly enhance the deterrent effect of sanctions by any one MDB. Cross-debarment would effectively multiply the economic impact of a debarment on a firm or individual by foreclosing the possibility of the firm or individual winning contracts with the other MDBs.

Bottom-line is if one firm is debarred by one Multilateral Development Bank (MDB), it is debarred by other banks as well. Any projects in which these Chinese Companies or individuals are associated with, will be denied assistance from any of these Multilateral Development Bank (MDB).

Many projects on CPEC in Pakistan will be impacted as a result of these sanctions by World Bank on 198 Chinese firms and individuals. Many projects in African continent and other Asian countries will also be impacted.

World Bank Lists 198 Chinese Ineligible Firms and Individuals

The firms and individuals listed in Table 1 below are ineligible to be awarded a World Bank-financed contract for the periods indicated because they have been sanctioned under the Bank’s fraud and corruption policy as set forth in the Procurement Guidelines and the Consultant Guidelines (for projects before July 1, 2016); or through the World Bank Procurement Regulations for Investment Project Financing Borrowers (for projects after July 1, 2016).

Such sanction was imposed as the result of:

(1) an administrative process conducted by the Bank that permitted the accused firms and individuals to respond to the allegations. Through July 2007, this process was conducted in accordance with the Sanctions Committee Procedures adopted on August 2, 2001. The process is currently conducted in accordance with Bank Procedure: Sanctions Proceedings and Settlements in Bank Financed Projects. (2) cross-debarment in accordance with the Agreement for Mutual Enforcement of Debarment Decisions dated 9 April 2010, which, as of July 1, 2011, has been made effective by the World Bank, Asian Development Bank, European Bank for Reconstruction and Development, Inter-American Development Bank, and African Development Bank.

*150 This matter was resolved through a Negotiated Resolution Agreement (NRA). The period of ineligibility of SNC-Lavalin, Inc. extends to any legal entity that it directly or indirectly controls. The period of ineligibility is the 10 year period indicated in the posting above; provided, however, that after a minimum period of 8 years, SNC-Lavalin, Inc. may be released from ineligibility if the World Bank Group’s Integrity Compliance Officer has determined that all of the conditions for release from sanction have been met, including: (a) the implementation of a corporate compliance program acceptable to the Bank; and (b) full cooperation with the Bank, under the terms of the NRA. The sanction imposed on China Machinery Industry Construction Group Inc. extends to any legal entities that it directly or indirectly controls. The minimum period of ineligibility for China Machinery Industry Construction Group Inc. is the 48-month period indicated in the posting above. At the end of its 48-month period of debarment, China Machinery Industry Construction Group Inc. may be released from debarment provided that China Machinery Industry Construction Group Inc. (a) has met the corporate compliance conditions to the satisfaction of the Bank’s Integrity Compliance Officer; (b) has fully cooperated with the Bank; and (c) has otherwise complied fully with the terms and conditions of the NRA.

*449 This sanction is the result of a Negotiated Resolution Agreement (“NRA”). The sanction imposed on China Nuclear Industry Fifth Construction Co., Ltd. extends to any legal entities that it directly or indirectly controls. The minimum period of ineligibility for China Nuclear Industry Fifth Construction Co., Ltd. is the 24-month period indicated in the posting above. At the end of its 24-month period of debarment, China Nuclear Industry Fifth Construction Co., Ltd. may be released from debarment provided that China Nuclear Industry Fifth Construction Co., Ltd. (a) has met the corporate compliance conditions to the satisfaction of the Bank’s Integrity Compliance Officer; (b) has fully cooperated with the Bank; and (c) has otherwise complied fully with the terms and conditions of the NRA.

(江苏中天科技股份有限公司) (“ZTT”) extends to any legal entity that it directly or indirectly controls. The minimum period of ineligibility for ZTT is the twenty-month period indicated in the posting above. At the end of its twenty -month period of debarment, ZTT may be released from debarment provided that ZTT (a) has met the corporate compliance conditions to the satisfaction of the Bank’s Integrity Compliance Officer; (b) has fully cooperated with the Bank; and (c) has otherwise complied fully with the terms and conditions of the Settlement Agreement.

The minimum period of ineligibility is the three-year period indicated in the posting above; provided, however, that after this minimum period of ineligibility of three years, Zhongchen Road & Bridge may be released from ineligibility only if it has demonstrated to the World Bank Group’s Integrity Compliance Officer that it has complied with the following conditions: (a) it has taken appropriate remedial measures to address the sanctionable practice for which it has been sanctioned; and (b) it has put in place an effective integrity compliance program acceptable to the Bank and has implemented this program in a manner satisfactory to the Bank.

*491 The period of ineligibility of Shanghai Hetai Construction Engineering Co., Ltd. (“Shanghai Hetai”) extends to any legal entity that it directly or indirectly controls. The minimum period of ineligibility is the four-year-nine-month period indicated in the posting above; provided, however, that after this minimum period of ineligibility of four years and nine months, Shanghai Hetai may be released from ineligibility only if it has demonstrated to the World Bank Group’s Integrity Compliance Officer that it has complied with the following conditions: (a) it has taken appropriate remedial measures to address the sanctionable practice for which it has been sanctioned; and (b) it has adopted and implemented enhanced bidding policies and procedures in a manner satisfactory to the Bank.

*497 This sanction is the result of a Settlement Agreement. The sanction imposed on Beijing Jingold Construction Co., Ltd. extends to any legal entity that it directly or indirectly controls.

*498 The period of ineligibility of Hunan Water and Hydropower Construction Group Co., Ltd (湖南水总 水电建设集团有限公司) (“Hunan Water”) extends to any legal entity that it directly or indirectly controls. The minimum period of ineligibility is the three-year period indicated in the posting above; provided, however, that after this minimum period of ineligibility of three years, Hunan Water may be released from ineligibility only if it has demonstrated to the World Bank Group’s Integrity Compliance Officer that it has complied with the following conditions: (a) it has taken appropriate remedial measures to address the sanctionable practice for which it has been sanctioned; and (b) it has put in place an effective integrity compliance program acceptable to the Bank and has implemented this program in a manner satisfactory to the Bank.

*499 This sanction is the result of a Settlement Agreement. The sanction imposed on China Energy Engineering Group Hunan Electric Power Design Institute Co., Ltd. (中国能源建设集团湖南省电力设计 院有限公司) (“CEEC-HEPDI”) extends to any legal entity that it directly or indirectly controls. The minimum period of ineligibility for CEEC-HEPDI is the twenty-month period indicated in the posting above. At the end of its twenty-month period of debarment, CEEC-HEPDI may be released from debarment provided that CEEC-HEPDI (a) has met the corporate compliance conditions to the satisfaction of the Bank’s Integrity Compliance Officer; (b) has fully cooperated with the Bank; and (c) has otherwise complied fully with the terms and conditions of the Settlement Agreement.

*503 This sanction is the result of a Settlement Agreement. The sanction imposed on China Railway First Group Co. Ltd. (“CRFG”) extends to any legal entity that it directly or indirectly controls. The minimum period of ineligibility for CRFG is the 24-month period indicated in the posting above. After 18 months, CRFG and its Sanctioned Affiliates may be released from debarment and converted to a sanction of conditional non-debarment, for a further period of six months commencing on the day after the expiration of the initial period of debarment, provided that (i) CRFG applies for a conversion of sanction to the World Bank Group Integrity Compliance Officer (“ICO”) in accordance with the Sanctions Procedures; and (ii) CRFG and its Sanctioned Affiliates have fully cooperated with the WBG in accordance with the Settlement Agreement. If the foregoing conditions are not met, the initial period of debarment shall continue for the additional six-month period. At the end of its period of sanction, CRFG and its Sanctioned Affiliates may be released from conditional non-debarment or debarment with conditional release, as the case may be, provided that CRFG and its Sanctioned Affiliates (a) have met the corporate compliance conditions to the satisfaction of the ICO; (b) have fully cooperated with the WBG; and (c) have otherwise complied fully with the terms and conditions of the Settlement Agreement.

*507 The period of ineligibility of Tengwangge Construction Engineering Group Co., Ltd. (滕王阁建工集 团股份有限公司) (“Tengwangge Construction”) extends to any legal entity that it directly or indirectly controls. The minimum period of ineligibility is the three-year period indicated in the posting above; provided, however, that after this minimum period of ineligibility of three years, Tengwangge Construction may be released from ineligibility only if it has demonstrated to the World Bank Group’s Integrity Compliance Officer that it has complied with the following conditions: (a) it has taken appropriate remedial measures to address the sanctionable practice for which it has been sanctioned; and (b) it has put in place an effective integrity compliance program acceptable to the Bank and has implemented this program in a manner satisfactory to the Bank.

*508 The period of ineligibility of Jiangxi Changhong Horticulture Construction Co., Ltd. (江西昌宏园林 建设有限公司) (“Jiangxi Changhong”) extends to any legal entity that it directly or indirectly controls. The minimum period of ineligibility is the three-year period indicated in the posting above; provided, however, that after this minimum period of ineligibility of three years, Jiangxi Changhong may be released from ineligibility only if it has demonstrated to the World Bank Group’s Integrity Compliance Officer that it has complied with the following conditions: (a) it has taken appropriate remedial measures to address the sanctionable practice for which it has been sanctioned; and (b) it has put in place an effective integrity compliance program acceptable to the Bank and has implemented this program in a manner satisfactory to the Bank.

*512 This sanction is the result of a Settlement Agreement. The sanction imposed on Jiangxi GeoEngineering (Group) Corporation (江西省地质工程（集团）公司) (“Jiangxi GE”) extends to any legal entity that it directly or indirectly controls. The minimum period of ineligibility for Jiangxi GE is the 15-month period indicated in the posting above. At the end of its 15-month period of debarment, Jiangxi GE may be released from debarment provided that Jiangxi GE (a) has met the corporate compliance conditions to the satisfaction of the Bank’s Integrity Compliance Officer; (b) has fully cooperated with the Bank; and (c) has otherwise complied fully with the terms and conditions of the Settlement Agreement.

*520 The period of ineligibility of Yunnan Jincheng Construction Engineering Co., Ltd. (“Yunnan Jincheng”) extends to any legal entity that it directly or indirectly controls. The minimum period of ineligibility is the two-year-and-eight-month period indicated in the posting above; provided, however, that after this minimum period of ineligibility of two years and eight months, Yunnan Jincheng may be released from ineligibility only if it has demonstrated to the World Bank Group’s Integrity Compliance Officer that it has complied with the following conditions: (a) it has taken appropriate remedial measures to address the sanctionable practice for which it has been sanctioned; and (b) it has put in place an effective integrity compliance program acceptable to the Bank and has implemented this program in a manner satisfactory to the Bank.

*525 This sanction is the result of a Settlement Agreement. The sanction imposed on Liaoning-EFACEC Electrical Equipment Company Limited (“LEEEC”) extends to any legal entity that it directly or indirectly controls. The minimum period of ineligibility for LEEEC is the 20-month period indicated in the posting above. At the end of its 20-month period of debarment, LEEEC may be released from debarment provided that it has complied with the following conditions: (a) commits to developing an integrity compliance program consistent with the principles set out in the World Bank Group Integrity Compliance Guidelines; and (b) commits to continue to fully cooperate with the World Bank Group Integrity Vice Presidency.

Points to Ponder

As World Bank lists these above mentioned 198 firms and individuals ineligible, it brings to focus the corruption inherent in all Chinese deals and projects. This also highlights how the countries that deal with China and Chinese companies will be denied funds by the World Bank and other Multilateral Development Banks (MDB).

As a result all the Asian countries like Pakistan, Nepal, Sri Lanka, Maldives, Bangladesh, Myanmar and all the African countries that contracted with China for different projects will be the preys for the predatory loans by Chinese financial institutions and will be forced to live in the vicious Chinese Debt Trap with no way to exit.
